If a satellite dish system is imported and intended to be used for unlawful
decoding of encrypted signals, as prohibited in section 9(1)(c) of the
Radiocommunication Act, this constitutes an offence under section 10(1)(b)
of the Act. It is illegal to use an American DTH satellite service (also
referred to as grey market) in Canada to receive and decode encrypted
programming. Doing so is in contravention of section 9(1)(c) of the Act.

So according to the Supreme Court as of April 2002 it is illegal to decode
foreign (US) Direct to Home signals

There is also an appeal against this judgment which puts this ruling on hold
until the appeal is heard and a final judgment is made at that time. This
has been going on for years back and forth. Wasn't this brought forward to
the courts by Bell and or express vue and not Direct TV?

I very much respect the fact you researched and backed up with
documentation, personally I can't wait until they clear this up once and for
all. I just find it amusing when people shooting off their mouths with out

I also think if the CRTC would allow Canada TV to have the great programming
Direct offers and do so at reasonable pricing this wouldn't even be a topic
of conversation anymore.

I should have actually said that it is not illegal to own the equipment or
to even bring it (receivers, cards, dishes, etc.) across the boarder unless
requested by the RCMP that Customs stops you, but it is illegal to decrypt
any signal according to the Radiocommunications Act (which is what the first
post is selling, a means to decrypt the signal).

It's alot of BS if you ask me and I totally support the counter suit as a
denial of your/my Charter of Rights. As the suit points out the CRTC is not
offering us a choice, it is dictating what you/I can and can't view even in
light of the fact that the signal has been determined Public Domain by the
American courts. No matter how you look at it, it's all a money grab and
until the Canadian providers become American owned/controlled, it will
probably NEVER be resolved. Besides, learing about the technology is half
the fun of doing it yourself ;)

THE ORIGINAL CONCEPT WAS GOOD BY INTENT, BUT LACKED FORESIGHT.
In the beginning it was intent to protect our Northern culture from being
swallowed up by the Southern giants.
With the likes of free trade, the lobbyist wanted some guarantee our culture
(Amongst other things) would be protected.
By doing that the started slicing things a little to fine. We in Canada have
never been defined. What is a Canadian?
We are a multi linguistic, (two prominent) multi cultural, multi coloured
and multi this and that. Each and everyone
entitled to be recognised as a separate entity. The US is by definition a
melting pot. You are an American, first and foremost
Sure there are African and Asian and Latino Americans, with there on little
cultural communities, but they are not catered to
the way they are here. We just don't have the numbers to warrant separate
services for each. We are split up by gender, language, culture, age, race,
religion, political affixations and what ever.
Like I said it was a good Idea for about 3 seconds, but they have been
having problem with it ever since. If your not Italian why should you pay
for Italian broadcast in Toronto or a Mosque in Vancouver if your not
Muslim.
